Age discrimination meas to treat an employee less favourably because of their age.  The Age Discrimination in Employment forbids the discrimination against the people who are age 40 or older not  the workers which are under the age of 40.

It was passed in 1967 and prohibits the employment discrimination  against anyone who is at least 40 years in age. It was signed by President Johnson. It prohibits discrimination in hiring, wages, promotion and layoffs. Since 1986 it has prohibited mandatory retirement in most sectors.

Mandatory retirement based on age is permitted for the executives which are working at high policy making positions and are over 65.

It is applicable to the employers that have at least 20 employees.
