The judiciary has the power to supervise the other arms of government, that is the legislative and executive branches when they exceed their power so, Judicial review is one of the ways the judiciary use in checks and balance in the separation of powers. The Supreme court has the power to review, examine and decide whether a law or statute or administrative rules or treaty violates the Constitution of the US.

Although the constitution did not state whether the supreme court has the power to judicially review the acts of the other arms of government but it was stated in the case of Marbury v. Madison, an 1803 case. The supreme court held in that case that the constitution is the supreme law of the United States and the court must state any law or acts of the congress or government authorities in violation of the constitution as unconstitutional, null and void.
