The fraction of states that must approve a proposed amendment for it to be ratified is 3/4 states or 38 states out of 50. This rule is based on Article V of the constitution.

Further explanation

There are several requirements to add an amendment to the constitution, such as:

 1. At least two-thirds members of both Houses of Congress (the Senate and House of Representatives) or two-thirds of the state legislatures have to propose the same amendment to be debated.
 2. If fraction members are fulfilled, the proposed amendment is discussed at a national convention or by local conventions in each state.
 3. The amendment is validated if the legislatures of 3/4 of the states vote in favor.

This system represents a democracy because it does not favor small states over big ones. With this Article, each state has the same value and not based on its size or population.
