In US, there is such thing as freedom of speech (with some common-sense limitations), however same will get a person thrown in jail and sentenced to death in a country where any speaking out is deemed as illegal.

So, are you planning on offending someone by calling them stupid or are you planning on violating someone's religious beliefs by desecrating their house of worship?

Are you planning on showing an adult film to a bunch of kids or are you going to tell kindergarteners that Santa is not real?

Upset feelings are not exact damages to be shown in court to demand compensation, however a damage to one's reputation or causing a financial loss (or a loss of life if that offense goes too far) would land that person in legal trouble.
