Answer:

The very fact of a long historical development as legally independent states distinguishes the countries of Latin America from the Afro-Asian countries that gained independence only after the Second World War and were forced to solve such issues of state building that had been solved in Latin America for a long time (in particular, the construction of a system of state bodies, formation of political parties, principles of constitution building, etc.).

An integral attribute of Latin American constitutional law is represented by patriarchal-paternalistic traditions that were formed in Latin America in the era of colonialism and civil wars of the 19th century. In the future, such traditions began to be regarded by a number of historians as a characteristic feature of the socio-political life of the Latin American republics.

At the same time, it has become a tradition in Latin America to consider the army as the only guarantor of the stability of state legal institutions and an effective means of resolving the socio-economic conflicts of Latin American society, especially during acute political crises, since functioning democratic institutions were unable to solve the emerging problems.

From where does check ans balance came from
EastWind [94]
Checks and Balances

The system of checks and balances is an important part of the Constitution. With checks and balances, each of the three branches of government can limit the powers of the others. This way, no one branch becomes too powerful. Each branch “checks” the power of the other branches to make sure that the power is balanced between them. How does this system of checks and balances work?

The process of how laws are made (see the following page) is a good example of checks and balances in action. First, the legislative branch introduces and votes on a bill. The bill then goes to the executive branch, where the President decides whether he thinks the bill is good for the country. If so, he signs the bill, and it becomes a law.

If the President does not believe the bill is good for the country, he does not sign it. This is called a veto. But the legislative branch gets another chance. With enough votes, the legislative branch can override the executive branch's veto, and the bill becomes a law.

Once a law is in place, the people of the country can test it through the court system, which is under the control of the judicial branch. If someone believes a law is unfair, a lawsuit can be filed. Lawyers then make arguments for and against the case, and a judge decides which side has presented the most convincing arguments. The side that loses can choose to appeal to a higher court, and may eventually reach the highest court of all, the Supreme Court.

If the legislative branch does not agree with the way in which the judicial branch has interpreted the law, they can introduce a new piece of legislation, and the process starts all over again.

An effect of the new territory acquired by the US after the Mexican-American War was that states disagreed about
lara31 [8.8K]

Answer:  States disagreed about whether slavery should be allowed in the new territories.

Explanation:

The Mexican Cession was the large region of land that Mexico ceded to the United States in the Treaty of Guadalupe Hidalgo in 1848.  It included territory that would later become the states of California, Nevada, Utah, and parts of what would become Arizona, New Mexico, Colorado and Wyoming.  The Mexican Cession reignited tension on the issue of slave-holding states vs. free states.

The Missouri Compromise (1820) had admitted Missouri into the Union as a slave state with Maine being added at the same time to keep the balance of slave and free states equal.  It also prohibited any future slave states north of the latitude line 36 1/2 degrees north of the equator in territories of the Louisiana Purchase, with the exception of Missouri (north of that line) being admitted as a slave state.  Since that latitude line ran right through the middle of the Mexican Cession territory, there was bound to be further debate over the issue of slave vs. free states.
