In the Supreme Court case Korematsu v. the United States, the Court decided that the 14th amendment could be waived in case of an emergency such as war. The 14th amendment, which deals with equal citizenship and equal protection of the law, was ignored on the name of the threaten warfare implied.

Fred Korematsu was a Japanese-American man who chose to stay in San Leandro, California in violation of the Civilian Exclusion Order No. 34 of the U.S. Army.
