The Civil War was disastrous for the Creek Nation (also known as the Muscogee people), even though the majority of the tribe wished to be neutral. The first three battles of the war in Indian Territory happened when Confederate forces attacked a large and neutral band led by Opothle Yahola. Eventually, hundreds of Creek men fought on both the Union and Confederate sides. After the war ended, the reconstruction treaty of 1866 required the cession of approximately half of the Muscogee land , almost 3.2 million acres.
The Creek nation began a period of regeneration after the war. Public buildings, schools and churches were built, including the Creek National Capital building (1867) in Okmulgee, now the Creek Council House Museum, included in the National Register of Historic Places.In 1867, the Muscogee people adopted a written constitution, which provided for a Principal Chief and a Second Chief, a judicial branch, and two legislative chambers composed of a House of Kings (similar to the Senate) and a House of Warriors (similar to the House of Representatives.)
