I don't think it's justified.
The southern states had as many chances as the north and northeast states in creating the industrialized urban areas, especially doring the reconstruction period. 
But they chose to stay witht heir old ideology and resist the change. and each years the economic gap between the states becoming larger and larger.

They 'legislate from the bench' by striking down laws as unconstitutional. The Indian removal act was to allow President Andrew Jackson to negotiate with southern tribes for their removal to western lands. There was nothing in the west to help them prosper so a lot of the Native Americans died along the way (trail of tears). Im an enrolled member of the Crow Tribe so I'm pretty educated in these departments. Hope this helps!
