I believe the answer is: <span>If the attorney knows defendant is going to give false testimony

According to </span><span> Rule 3.3 of the Model Rules of Professional Responsibility, the American Bar Association ,  the attorney of the defendant wouldn't be legally liable to break confidentiality if the attorney for a fact that the defendant' testimonies are false.</span>
