(key word(s) is/are Avoid and Struggled to) which means some of them, including McDonalds probably did avoid this and some other McDonald's didn't avoid this.

Well, you are supposed to mention that it is an advanced work of the artist. or else, people will have a whole lot of anger toward you; they will call you a cheater, a liar, a copycat and lots more. if u don't know hat I mean, just imagine a painting that is very similar to Monalisa (the way she's sitting/ the setting).. wouldn't people start making a whole controversy? they would. so just mention that it is a detailed version of the original picture, or that it is your version of the picture.
