In this case in 1963, the Supreme Court unanimously ruled that states are required under the Sixth Amendment of the United States Constitution to provide legal counsel to defendants in felony cases who are unable to afford attorneys by themselves.

Mr Clarence Earl Gideon could not afford an attorney and his request for counsel.was denied by the Court with the excuse that the only time the court can appoint counsel to represent a defendant is when that person is charged with a capital offense.

However, Justice Clark's concurring opinion stated that the Sixth Amendment does not distinguish between capital and non-capital cases, so legal counsel must be provided for an indigent defendant in all cases.
