If the court decides a case based on substantive due process, it is determining : A whether  the law involve in a case is fair

Often times, there are a lot of external factors that could determine the fairness of law that being use. For example : age. 
We cannot use a law for an adult if we're dealing with kids or teenager in court

The reason being that in substantive due process in the United States constitutional law, is a principle which allows courts to protect certain rights deemed fundamental from government interference.
