The state legislature of state A enacted legislation prohibiting the use of tractor-trailer rigs weighing more than 100,000 poun

ds gross, on the basis that superheavy trucks rapidly degrade the state's roadways and pose a greater safety danger than smaller trucks. A trucking firm that frequently uses state A's highways for trips between state B and state C purchased several tractor-trailer rigs weighing over 100,000 pounds when loaded. The trucking firm brings an action for declaratory relief in federal court in state B, seeking to have the state A legislation declared unconstitutional. It presents expert testimony that the heavier trucks are no less safe than smaller models. State A produces no evidence, but asserts that the legislation is justified as an exercise of its police power.

Answer:

The trial court should rule that the legislation is unconstitutional because it violates the Commerce Clause.

Explanation:

 • Any legislation introduced and implemented by the state legislature inevitably has to comply with the United States Constitution for it to be valid.
 • The legislation that is believed to be unconstitutional can be appealed against in the court of law.
 • The court can also suo moto take an initiative to examine the constitutionality of the legislation introduced.

navik [9.2K]

Answer:

he is 100% confident in his reasoning

Explanation:

According to my research on the literary arts, I can say that based on the information provided within the question Paine most likely uses this language to convince his audience that he is 100% confident in his reasoning. This can be inferred because he compares his reasoning to something that is completely there and cannot be refuted (ray of light).

Dahasolnce [82]

Answer:

Rosa Parks or Emily Davison

Explanation:

Rosa Parks fought for equality and against segregation, by not giving up her seat on a bus in 1955. At the time, buses and other forms of transport were segregated between white skins and black skins. Black people had to sit at the back and whites at the front. If there were no more spaces and a white person came onto the bus, the black person would have to give up there space. Rosa Parks however, didn't do this and refused to move for a white man. This resulted in her getting arrested, but it paved the way for the future.

For example, even now, she still has an affect, seeing as buses aren't segregated at all.

Emily Davison gave up her own life by throwing herself under the King's horse at the Epsom derby in 1913. Though her direct intention isn't known, she was a suffragette fighting for women to get the right to vote. Her and other women eventually won this battle and now women are allowed to vote
