A major flaw was the system of government: the Articles of Confederation only had one house (Congress) which would assert all power, becoming an authoritarian government. The US Constitution established checks and balances between the legislative, executive, and judicial branches so they can evaluate a law and see if it is just and pertains to the Constitution.
