A criminal case is made when a defendant is accused of a crime committed against the state or society. The case usually starts with a police report or arrest. Information about the events revolving around and leading to the arrest, the witnesses’ names and other relevant data is noted. The case is brought to trial after a prosecutor (chooses to) file charges based on the report. The prosecutor also decides what charges to file and determines if the crime is a misdemeanor or felony. The defendant will then be given a lawyer as the trial proceeds.
