The provision is added on the Chapter 2 of the South African constitution, specifically under equality clause. The clause prohibit unfair treatment based on race or religion. Those who violate the clause will have to face either jail time or a certain amount of fine.

On top of that, the South African government also provided opportunities from people with different religion to come and obtain a congressional seat. This would made the religious community that they represented feel valued.
