First exercised in the case Marbury v. Madison, judicial review is the principle that gives the Supreme Court the authority and obligation to review the actions of the legislative and executive branch to determine if they have acted within the bounds of the Constitution.
I believe it would be the spy system. During the war, some americans were for and against the war and independence. To keep in the know of what the british were planning, there was an elaborate spy system to spread information on the british troops where people acted as they were for british rule. :)
