La importancia que tiene la Ley Penal Juvenil para la sociedad Costarricense es elevada, pudiéramos decir que es una prioridad ya que los índices de criminalidad en los adolescentes o jóvenes Costarricenses se ha incrementado considerablemente en los últimos años.

Estamos hablando particularmente de jóvenes de los 13 a los 19 o 20 años de edad, que por diversas causas han tenido que abandonar los estudios o dejar de trabajar, y han decidido delinquir.

El gobierno de Costa Rica, preocupado por el alza en la criminalidad de este grupo vulnerable, ha creado una serie de legislaciones enfocadas a detener los índices delictivos y con ello disuadir a los jóvenes a que dejen las calles y el crimen, para poder regresar al estudio o a un trabajo digno

La Ley de Justicia Penal Juvenil se promulgó en 1996. La ley de Ejecución de las sanciones penales se aprobó en 2005. Ambas tuvieron como objetivo implementar las sanciones apropiadas para que no sólo se castigara las penalidades de los jóvenes, sino se considerada su pronta reincorporación a la sociedad productiva.
