First, Hamilton says that life tenures frees judges from political pressure that come from the legislature or executive. This allows judges to guard against unconstitutional laws. Then, he says that judges have lots of demands, which shows that only few men are able to become judges because of their ethical qualities.Federalist No. 78 discusses the power of judicial review. It argues that the federal courts have the duty to determine whether acts of Congress are constitutional and to follow the Constitution when there is inconsistency. Hamilton viewed this as a protection against abuse of power by Congress.

Hamilton envisioned the judiciary as being the "weakest" and "least dangerous" of the three great branches of government: "Whoever attentively considers the different departments of power must perceive, that, in a government in which they are separated from each other, the judiciary, from the nature of its functions.
