The Tribunal decided that the arrest, which had taken place outside Guinean jurisdiction, was an illegal application of the right of hot pursuit and had moreover been carried out with excessive use of force. It awarded damages in the total of 2.1 million US Dollars for the shipowner, charterer and members of the crew.
