A man, who was a robbery suspected said to be armed with a gun was shot by a shop owner when he tried to rob his store. The commonwealth could not establish that it would be fitting under the fourth amendment terms to seek crime evidence of this category by simply requesting for surgery.  

The court ordered the surgery to be conducted but the results of the x-rays before the scheduled procedure showed that the bullets went much deeper than expected and the risks were higher than anticipated.
