After the civil war the south also known as the confederacy needed to reconstruct its economy, Its social structure, and it's overall being remembering that a war had just torn through the country. Reconstruction ultimately failed in 1877 after Rutherford b. Hayes negotiated with Louisiana and more states to remove federal government if they aided him to become president.

They could be considered both. They used their money to influence local, state and the federal government. Laws were not passed or not enforced that would regulate big business. However, many of the these same men gave large sums of money (philanthropy) to charities.
