Direct vs virtual representation. Imperial vs. local control by representative colonial assemblies. Popular sovereignty and the common law rights of englishmen to live under a government of their own choosing vs. arbitrary imperial control. British felt that parliament should be trusted to represent them because colonists are still englishmen and so parliament will look out for them. Americans do not approve of this idea. Overall sense that americans were different.

The lack of ability to raise taxes to operate the national government, and the requirement for a unaimous vote of the state's to pass legislation. The federal government had no way to force the states to obtain the funds it needed to operate. State only sent funds it needed to operate.

In Federalist No. 78, Hamilton said that the Judiciary branch of the proposed government would be the weakest of the three branches because it had "no influence over either the sword or the purse, ...It may truly be said to have neither FORCE nor WILL, but merely judgment." Federalist No. 78 quotes Montesquieu<span>: "Of the three powers [...], the judiciary is next to nothing." There was little concern that the judiciary might be able to overpower the political branches; since Congress controlled the flow of money and the President the military, courts did not have nearly the same clout from a constitutional design standpoint. </span>

It was perceived as an organization that was content to advance a certain amount of economic progress within the larger white power frame and without trying to change the existing white power structure, which was dominated by segregation and jim crow. </span>
