Under Texas law, The House of Representatives begins the process of impeachment. The House must cast a majority vote in favor of impeachment in order for impeachment proceedings to be pursued. The trial of impeachment then is conducted by the State Senate. If impeached, the official is removed from office. If there are further criminal charges to be brought, those are then handled by separate indictment and criminal trial. In the history of the state of Texas, two state officials have been successfully impeached. Governor James Ferguson was removed from office in 1917 over charges of embezzlement and misuse of public funds. District Judge O.P. Carrillo was impeached in 1975 on income tax charges and then was convicted on criminal charges.
