1. Dred Scott was not a person protected by the Constitution
2. Slaves are property
3. Property cannot be taken from an owner without due process

Under these three premises, Dred Scott could not be free of a slave owner under any circumstance because he was a slave, therefore not a person but property, and couldn't be taken away unless due process was served on his master.

In my opinion, yes, there are still groups who are disenfranchised and not considered as an equal source of power in our democracy. An example of these people is those in the lower class of the society. In today's setting, only the 'representatives' have power and those whom they represent do not. <span />
