The corrrect answer is B) rights unlisted in the Constitution.

The 9th amendment essentially states that any rights not guaranteed to citizens in the Constitution or given directly to the federal government, will belong to the people respectively. This amendment was based on the Anti-federalist fear of a strong central (federal ) government.

When the new constitution was being developed at the Constitutional Convention, Anti-federalists fought to give the people as many rights as possible, as they feared a strong central government like the one America experienced when they were under the control of the British. This is why the 9th amendment exists, to ensure that people ultimately have a significant amount of power and freedom in American society.

The ninth amendment of the U.S. Constitution protects rights which, although not in the constitutional list, are nevertheless kept by the citizens. The Amendment IX in the American Constitution addresses those rights of the people, which they are to retain, even if they are not included in the Constitution.

Further explanation:

This constitutional amendment states that details given about certain rights in the U.S. Constitution ought not to be interpreted in such a way that it may be used to disallow or belittle other rights, which belong to the citizens of the country. Also known as Amendment IX, it was introduced by the founders of America. This was introduced, in the year 1791, because, during the drafting of the American Constitution, some of the founders of the newly-born American nation were concerned that, in the future, it could be pointed out that since a certain specific right was not in the U.S. Constitution, hence that right never existed. In order to counter this, a new amendment, now known as Amendment IX, was included in the constitution of the country.

In practice, Amendment IX has rarely been used in the U.S. Constitutional law. It has generally been viewed by the judiciary as limiting the expansion of government powers on the basis of rights mention in the constitution, without hindering further expansion of the government’s power.

xxMikexx [17]

Although the Equal Rights Amendment (ERA) had strong popular support when it passed both the House and the Senate in 1972, it failed to become a constitutional amendment because the feminist movement had made so many gains in eliminating gender discrimination.

Failure of Equal Rights Amendment (ERA)

 • The feminist movement had achieved so much in the fight against sexism in areas like employment and education that it did not necessarily seem necessary for the Equal Rights Amendment (ERA) to pass both the House and the Senate in 1972, despite the fact that it had strong public support at the time. As a result, the ERA did not become a constitutional amendment.
 • The Equal Rights Amendment ultimately failed to be ratified by the required 38, or three-fourths, of the states by the deadline set by Congress because of a conservative backlash against feminism.
 • Because a state's legislature must pass it through both houses in the same session in order for it to be considered ratified, it failed in those states.
