Though you may be referring to the Ku Klux Klan, many groups used violence against African Americans during that period due to prejudices and discrimination and the racism of the time. African Americans did not have any recourse legally. it wasn't illegal due to the racism and backlash of the emancipation of the slaves and prior civil war as well.
