In the McCulloch vs. Maryland case, it was decided that the US federal government did have the right to develop a national bank. The Supreme Court ruled that the power to create the national bank was protected by Article 1 Clause 8 of the US Constitution. This section contains the "Necessary and Proper" clause. McCulloch, who was cashier of that bank refused to pay the tax and state of Maryland Sued him. The McCulloch v. Maryland case had significant effect on what federalism means for United States. This case enhanced federal power and gave federal powers ways to achieve the responsibilities which were given in the constitution. This case also established a precedent among people that Congress had power to incorporate any bank.
