I’m korematsu vs us (1944) the Supreme Court ruled that in a time of great “emergency and peril” the internment of Japanese Americans was constitutional.

This ruling by the Supreme Court declared constitutional the Executive Order 9066, which ordered Japanese Americans into internment camps during World War II, despite their citizenship. It stated that the necessity to protect the country against espionage in times of war was more important than the rights of these considered second-class citizens.
