David Payne was prosecuted for his second intrusion of Indian Territory, and the trial was overseen by Judge Isaac Parker.
David Lewis Payne (1836-1884) was a Pioneer and American soldier very respected in the Oklahoman territory. He formed an Army that entered in the unassigned territories. In 1880 he led a group of men from Wichita, Kansas to Oklahoma. They established a town called Ewin, but a group of the 4th of the US Cavalry arrested them and escorted them back to Kansas.
