Vice President Tyler assumed the presidency after the death of President William Henry Harrison using the implied powers clause of the Constitution, though later the 25th Amendment would state that in the “case of the removal of the president from office or of his death or resignation, the vice president shall become president.”

In the presidential election of 1840, the Whig Party elected Tyler as vice president along with the candidacy of William Henry Harrison. John Tyler took the position of president, after the sudden death of Harrison. This makes him the tenth President of the United States, from 1841 to 1845.

Using electors instead of the popular vote was intended to safeguard against uninformed or uneducated voters by putting the final decision in the hands of electors most likely to possess the information necessary to make the best decision; to prevent states with larger populations from having undue influence; and to compromise between electing the president by popular vote and letting Congress choose the president. According to Alexander Hamilton, the Electoral College is if “not perfect, it is at least excellent,” because it ensured “that the office of President will never fall to the lot of any man who is not in an eminent degree endowed with the requisite qualifications.” [7]
