They did this in the 2007 case Boumediene v. Bush. Here the Supreme court ruled that it was illegal to deny the Guantanamo prisoners the right to present habeas corpus (a petition to court in order to discern the legal validity of the imprisonment)  to the federal courts which article 7 of the Military Commissions act forbade.
