The justice of the peace is considered a treaty under the constitution. A Justice of the peace (JP) is a judicial general of a puisne or a lower court, appointed or elected utilizing a command (letters patent) to maintain the peace.

EXPLANATION:

There are some facts in the case of Justice of the Peace around the world:

• Justice of the Peace, in the Anglo-American legal system, a local judge is empowered primarily to administer civil or criminal justice in small cases. A justice of the peace may also provide vows and conduct marriages in some jurisdictions.

• In England and Wales, a judge is appointed in the name of the crown, to maintain peace in certain districts. The task of modern peace judges, who preside over the courts of England and Wales, evolved from what was first given to them under the Peace Justice Act of 1361. Basically, since 1971, the judges continue to send more critical cases to a higher court for disposition and to deal mostly with minor criminal problems, to the Crown Court or any court that established the High Court of Justice.

• In England and Wales, the modern justice of the peace, as before, is often a layperson. However, every person appointed now has a training course in basic law and the administrative duties of the judge's court. For legal matters, the advice is given by officers to the court. Lay judges must number at least two to listen to the case. Judges who are paid full time can listen to the cases alone. In some less critical criminal matters, a justice of the peace can be occupied by judges of the Crown Court.

• In England and Wales, there are some 28,500 justices of the peace, one-third of whom are women. The rising caseload of juvenile matters now takes a larger amount of the court time of the magistrates. The justices who rule on the care of children or hear these cases take special courses in juvenile law.

• In Australia, the major function of the justice of the peace is to validate the execution of documents.

• In the United States, justices of the peace are elected or pointed and placed in the lowest court of a court of law listening to minor civil cases and minor criminal cases, usually minor violations. They lead at weddings, deliver arrest warrants, deal with traffic violations, and conduct inspections.
