Often first time offenders would have the ability to turn around their behavior. Being exposed to the severe criminal element of prisons or jails could in fact breed a worse criminal rather than deterring them from their felonious or criminal behavior. I think the severity of the act should depend on the jail time associated with it and if they are able to enroll in diversion programs. So it some ways I would argue that it is fair.

2)  The government should establish an exact administration of justice in the context of order and law. These refers to have a court system to apply the right justice for all citizens of a society in an equal manner.

Negative reinforcement is based on operant conditioning theory. In negative reinforcement a positive behavior is enhanced by taking away a negative outcome or eliminating an aversive stimulus.

Aversive stimuli is everything that brings someone physcally or psychologically discomfort.

Negative reinforcement then means someone is able to avoid aversive stimuli prior to its occurrence. It is like taking prevention rather cure so you eliminate what ever can bring you a negative outcome before the negative outcome occurs.
