The Supreme Court is most likely to be accused of judicial activism in cases involving:  protection of individual rights.

Writing for the conservative group, The Heritage Foundation, Elizabeth Slattery defines judicial activism as "when judges fail to apply the Constitution or laws impartially according to their original public meaning, regardless of the outcome, or do not follow binding precedent of a higher court and instead decide the case based on personal preference."

Cases involving individual rights are likely to elicit charges of judicial activism because the Constitution does not spell out each and every sort of right citizens may have.  New questions come up that were not considered or specified at the time the Constitution was written.  For instance, Roe v. Wade (1973) addressed the question of abortion and an individual's right to privacy.  Obergefell v. Hodges (2015) addressed the legality of same-sex marriage.  Both are cases of individual rights, where the Constitution did not give direct instruction on the issues at stake.  The decisions on those issues, to allow abortion and to allow same-sex marriage, both are criticized by conservatives as instances of judicial activism.

The implementation of total war was a strategy picked by the Union officers for multiple reasons.

1) Total war will result in the destruction of Southern supplies and transportation. Sherman destroys railroad tracks, burns crops, and ruins plantations so that the Southern army/citizens have no resources to survive.

2) It will bring the Civil War to an end much quicker.

Sherman's idea of destroying the South can be viewed as an immoral action. This is due to the fact that Sherman and his troops will be destroying the land and property of individuals who may not even be part of the war or the Confederate war effort.

After the Revolutionary War, the colonists created an executive branch with constitutional limits in order to prevent tyranny from the government and let the states still have power.

The Articles of Confederation was the first constitution for the United States, it was very weak and gave the national government little to no power. The government could barely create and enforce laws, regulate trade, draft soldiers, or tax the people.

Some people preferred this, as they felt like the power should be in the hands of the people and were scared of tyranny, as they had just broken away from British rule during the Revolutionary War. Still, some people wanted to create a stronger government and felt like the Articles of Confederation were doing more harm than good.

During the Constitutional Convention of 1787, the Articles of Confederation ended up getting scrapped and the United States Constitution was created instead. This created three branches of government, one of them being the executive branch, where the president is. Many people feared that the president would become too powerful, so they made each branch have constitutional limits. These are called separation of powers and checks and balances, each branch is powerful in its own ways and holds certain powers over others to keep each other in check.
