The different factors to determine whether the defendant qualifies for a diversion. Such factors include:
- the offender's capacity for rehabilitation,
- the circumstances of the offense,
- the offender's criminal history,
- the offender's socioeconomic background,
- the offender's mental and physical health,
- and the value of deterrence to the offender and society as a whole.
