Why do you think the early leaders of the nation did not include a “Supremacy Clause” in the Articles of Confederation

Answer: The Articles of Confederation had made all states independent and supreme leader. Congress served as the last option to resolve any dispute. If Supremacy Clause would have been included than Congress would have all the powers and state would loss their independence. So, it was not included in the Articles of Confederation.

Explanation:

The Articles of Confederation gave all power of ruling to individual states and Congress had very little role to play. Congress had the authority to create and sign treaties and alliances. They were also maintained army and monetary side. But still they had no hand in tax and commerce part.

This Article was created by second Continental Congress.

On the other side, Supremacy Clause gave Congress laws priority over state laws. It declared that state courts are to be governed by the supreme law.

The New Jersey Plan included The Supremacy Clause in 1787.
