The <u>offeror</u> must have serious intention to become bound by the offer. The terms of the offer must be reasonably certain, or definite, so that the parties and the court can ascertain the terms of the contract. The offer must be communicated to the offeree. For an agreement to be initiated and binding, the offeror must be willing to become bound by the offer and the terms of the contract must be made clear, the offer must be communicated to the offeree who considers it, and decides whether to accept it or reject it. It becomes a binding contract when the offeree accepts the offeror's offer.
