The United States Supreme Court made a landmark decision concerning Tinker v. Des Moines. This decision was related to the different rights that the students had in U.S. public schools according to the First Amendment.

There is a test known as the Tinker test, which courts use today to determine the interest that a school could have to avoid infringements in the student's rights established in the First Amendment.

The court's 7–2 decision stated that the First Amendment must be applied in the different public schools, as well as established that administrators must demonstrate valid reasons according to the Constitution to regulate the use of speech in the classroom.
