Probable cause protects people's rights by making sure that citizens property is not seized unless there is a legitimate reason.

In the fourth amendment of the US Constitution, it states that American citizens are protected from illegal search and seizures. This is one of the many protections offered by the Bill of Rights.

This particular amendment prevents the government from taking people's personal property. The only time that the government or a law enforcement official may search or confiscate someone's personal property is if:

A) They have a warrant signed by a judge.

B) If they have probable cause.

Probable cause is based around the idea that there needs to be some type of evidence or information that results in the law enforcement official deeming it necessary to investigate or seize someone's property.

Law enforcement officials can use probable cause in many scenarios. For example, if someone is driving and the police officer pulls them over and smells alcohol in their vehicle this would give the officer probable cause. This would allow the officer to search the vehicle, as the smell of alcohol is evidence that illegal activity may be going on.
