In terms of sheer ability, the government can order the military to act, and be held responsible for the consequences. However, under the Rule of Law, the government does not have the political authority to do so. As it cannot act against the rights and liberties of people. The Rule of Law prevents precisely that: an arbitrary action from the government against its own citizens. The moment a government uses its power arbitrarily and without political authority, the Rule of Law is broken.
