Explanation: Scienter be defined simply as an intentional act of damage. In an event whereby a perpetrators has clear knowledge of an act as being legally wrong or unlawful and still goes ahead to commit such offense.

Bruce had prior knowledge that tampering with the odometer( keeps track of the mileage of a car from time of purchase till date) of a vehicle is an offense and still went ahead to run it back so it would appear it had fewer miles probably to increase the buying potential or market price of the vehicle.

for the fact that, Bruce intentionally did it shows that he wanted an undue advantaged while selling the car to Wally who ended up bearing the losses.  In a sane situation, Wally would definitely charge Bruce with fraud for that singular act.
