On Monday, Travis took his four-wheeler to Reppart's Equipment & Service for repair because the steering was not working pro

perly. On Friday, he called Reppart's to see if his four-wheeler was ready because he wanted it for a weekend trip. Reppart's said they had done the major repairs but that the steering system still needed some work and they needed another few days to finish the repairs. Travis told them he would pick the four-wheeler up and use it for the weekend and then bring it back to have them finish their work. While riding with friends on the weekend, Travis ran into someone because the steering stuck and he couldn't swerve to avoid them. Discuss how a court would determine causation in a negligence suit against Travis.

Answer:

The service repair company advised Travis of the issues with the steering problems.  He disregarded the notice and decided to drive the four wheeler before fixing the issue.  Therefore, Travis assumed all responsibility after knowingly driving the four wheeler after being told of its issues.  The people who he hit and caused damaged or injury to would clearly  have a case against him.  Perhaps even if he wasn't aware of the problems and caused damage to their persons or property, he would still be at fault. However, in that situation, he would likely be able to go after the service repair shop showing negligence on their part for failure to disclose this information.

What happens if the defendant fails to report to court on the trial date?
Harrizon [31]

Answer:

A warrant is issued for the defendant's arrest

Explanation:

This type of warrant is called a bench warrant or a failure to appear.  In most cases, if a person is arrested on a failure to appear warrant, they are held in jail until they go in front of a judge.  The judge will usually then hear the original charge(s) and sentence the individual on those charges.

Most deterrence effects and reductions of crime are more highly influenced by informal elements, such as ______. Select one: a.
luda_lava [24]

Answer:

A.

Explanation:

The Deterrence theory is a theory in criminology whic suggests that the possible threats of punishment will help to reduce the amount of crimes in a society.

But, according to the study by Death Penalty Information Center, punishment has not improved these numbers, instead there are more crimes committed.

The informal controls that are supposed to be highly influential in reductions  of crimes are families and communities ties. These bonds are considered to be the most influential elements that helps to deter crime rates in any society. Having a loving and affectionate environment at home prevents a child to involve into any delinquent activities and thus keeps him/her away from criminal activities.

Thus the correct answer is option A.

Who is sued in a criminal lawsuit
SpyIntel [72]
A civil case begins when a person or entity (such as a corporation or the government), called the plaintiff, claims that another person or entity (the defendant) has failed to carry out a legal duty owed to the plaintiff. Both the plaintiff and the defendant are also referred to as "parties" or "litigants." The plaintiff may ask the court to tell the defendant to fulfill the duty, or make compensation for the harm done, or both. Legal duties include respecting rights established under the Constitution or under federal or state law.
