Judicial activism is the view that the Supreme Court and other judges can and should creatively (re)interpret the texts of the Constitution and the laws in order to serve the judges' own visions regarding the needs of contemporary society. Judicial activism believes that judges assume a role as independent policy makers or independent "trustees" on behalf of society that goes beyond their traditional role as interpreters of the Constitution and laws. The concept of judicial activism is the polar opposite of judicial restraint.

Judicial restraint refers to the doctrine that judges' own philosophies or policy preferences should not be injected into the law and should whenever reasonably possible construe the law so as to avoid second guessing the policy decisions made by other governmental institutions such as Congress, the President and state legislatures. This view is based on the concept that judges have no popular mandate to act as policy makers and should defer to the decisions of the elected "political" branches of the Federal government and of the states in matters of policy making so long as these policymakers stay within the limits of their powers as defined by the US Constitution and the constitutions of the several states.

Judicial restraint limits the powers of judges to strike down a law. As opposed to the progressiveness of judicial activism, judicial restraint opines that the courts should uphold all acts and laws of Congress and legislatures unless they oppose the United States Constitution.

slava [35]
Dual federalism is also referred to as 'layer cake' federalism due to the clear presence of layer in the cake. In the cooperative federalism, the line of distinction between the powers and responsibilities of the national government and the state governments is blurred.

If the government increase its regulations on business, production costs godown and firms are able to produce more at all possib
enot [183]

Answer:

FALSE

Explanation:

Government regulation is needed in almost every industry to prevent predatory practices that are harmful to the consumer, the environment, and the financial system. For example, regulation prevents firms from abusive pricing or cartels. From the firm's point of view, regulations represent a cost, since firms need to adapt to the conditions that the government imposes for companies in that sector. For example, companies that sell oil need to comply with environmental regulations. This generates costs for companies such as employee training, hiring attorneys to interpret legal rules, use of less environmentally harmful technologies during the oil exploration process, among others.

in what ways did the constitution address the idea of no taxation with representation"? In what ways did it fall short.
qaws [65]

Answer: Taxation without representation was possibly the first slogan adopted by American colonists chafing under British rule.1

They objected to the imposition of taxes on colonists by a government that gave them no role in its policies.

In the 21st century, the people of the District of Columbia are citizens who endure taxation without representation.

Explanation:The phrase taxation without representation describes a populace that is required to pay taxes to a government authority without having any say in that government's policies. The term has its origin in a slogan of the American colonials against their British rulers: "Taxation without representation is tyranny."1
