In reference to Case 2 "Surrogate verses Father": Should the father have any rights to the child in this case? In other words, w

hen determining the custody of a child, should "who" gestates it carry more weight than genetic links to it (that is, to where the sperm and egg came from)? Do you agree or disagree with the Florida law in this scenario? Why or why not?

Answer:

With reference to the Case stated above about "Surrogate verses Father", I think the genetic link should carry more weight than who gestates it when determining the custody of the child.

This is based on the existing florida law which specifies the type of method to be adopted for bearing children by a surrogate mother (That is, traditional surrogacy or Gestational Surrogacy).

Why I agreed with the Florida Law was because the connection between the parents who sort the services of the surrogate lady is far paramount than surrogate lady who simply serves as a gestation environment. The genetic link and features like the facial features of the child, the blood group, the skin colour, the personality traits of the child (introverted child or extroverted child ) are more important and helps in determining the child's custody.
