arrest the suspect for abusing his domestic partner, who consents to a search of the home she share with the suspect while his in jail. Should such searches over the objection of an absent resident be allowed?
yes if the officers have probably cause and have at least consent or a search warrant than the officers have every right to search the home if the other is in absent of their own home.
Police say: if two occupants are PRESENT and only one consents the police cannot search the residence. But if the suspect is being held in jail that means they are NOT PRESENT, if the suspect’s domestic partner gives consent to search the home police shall proceed
and if they dong evidence that he stole u can also file for false accusation which can be used when a claim or allegation of wrongdoing that is untrue and/or otherwise unsupported by facts.
