How does the presidential power of commissioning all the officers of the United States link to Marbury v. Madison (1803)?

Answer:

Explanation:

the power to commission officers, as applied in practice, does not mean that the President is under constitutional obligation to commission those whose appointments have reached that stage, but merely that it is he and no one else who has the power to commission them, and that he may do so at his discretion. Under the doctrine of Marbury v. Madison, the sealing and delivery of the commission is a purely ministerial act which has been lodged by statute with the Secretary of State, and which may be compelled by mandamus unless the appointee has been in the meantime validly removed. By an opinion of the Attorney General many years later, however, the President, even after he has signed a commission, still has a locus poenitentiae and may withhold it; nor is the appointee in office till he has this commission. This is probably the correct doctrine.

According to what is expressed in the fragment, it can be inferred that the purpose of the sentence is to clarify that laws are created to modify human behavior.

What is a law?

A law is a term to refer to a norm or rule of society that citizens must comply with in order to live in harmony with others.

Laws are one of the oldest social tools in the world because they guarantee that citizens have a more controlled behavior with respect to others. Additionally, this provides them with some obligations that they must fulfill to belong to the social group.

According to the above, it can be inferred that the fragment refers to the fact that laws are an adequate tool to modify human behavior according to the needs of society.

Oksanka [162]
The SCOTUS did not rule that T.L.O’s 4th amendment (searches and seizures) rights had been violated. They ruled that the school administrations search of the bag was reasonable under the circumstances (i.e T.L.O. Being a minor and on school property, meaning that while at school, administration is responsible for the well-being and safety of all students, thus allowing them to search T.L.O’s bag for marijuana). A good way to think of it is that while you’re at school, the administration acts as your parents. Your parents don’t need a warrant to search through your room and neither does the administration if you are on school property. The 4th amendment applies to this case because it protects against unlawful searches and seizures (i.e. searches and seizures that are without a warrant). The constitutional question was whether or not T.L.O. Could be charged with a crime/punished or not because the school administration did not have a warrant. However, because the school administration was acting as a loco parentis (latin term for “in place of the parent”) they did not need a warrant to search her bag. Hope this helped!

By law, when food originally contains 50 percent or more of its calories from fat, and the food company reduces the fat by 50 percent or more during processing, the food can be labeled as light.

What is law?

It should be noted that law simply means the principles that are put in place to guide the actions of people.

In this case, when food originally contains 50 percent or more of its calories from fat, and the food company reduces the fat by 50 percent or more during processing, the food can be labeled as light.
