Historically, people with disabilities have been excluded from society and have faced neglect, abuse, and stigma. People with disabilities were excluded from schools, organizations, and many were hospitalized or sent away from their homes. Today, people with disabilities are included in schools (mainstream; IDEA 2004), organizations, and there are laws that protect people with disabilities from discrimination (American with Disabilities Act).
A strict scrutiny is constitutional law of the united states that is considered as the highest standards of the judicial review and must satisfy the three tests like it must justify the completing governmental interests, must be narrowly tailored to meet the interest and the goals of the government, and laws or policies must be less restrictive for achieving the needs and interests of the people.
