During the 1984 Republican National Convention held in Dallas, Texas, Gregory Lee Johnson burned an American flag protesting the policies of President Ronald Reagan. He was arrested with violation of a Texas statute and the Texas court tried to convict Johnson and was sentenced to one year in prison, and fined $2,000 but he appealed arguing that his actions were symbolic speech protected by the First Amendment. Justice William Brennan agreed with Johnson and agreed to hear the case where Johnson was represented by attorneys David D. Cole and William Kunstler.
