He was arrested with violation of a Texas statute and the Texas court tried to convict Johnson and was sentenced to one year in prison, and fined $2,000 but he appealed arguing that his actions were symbolic speech protected by the First Amendment. Justice William Brennan agreed with Johnson and agreed to hear the case where Johnson was represented by attorneys David D. Cole and William Kunstler.
