When a person claims damages to another, this is because this person was injured as a result of a wrongful action performed by the second,which in this case, would have been not to take the correct safety measures  for a donkey basketball game, in other words, the Board would have been liable of negligence.

The defense in this case should prove the Board was not negligent, as they took all reasonable and required safety measures that would have been expected for a basketball donkey game, that would prevent a person to fall off the donkey during the game and also, should prove that the tecaher could have acted in a way in wich she could have been responsible for the accident.
